1. Acceptance of Terms
By downloading, installing, or using Food Truck POS (the "App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.
These Terms apply to the iOS application and any associated web dashboard or backend services provided by Food Truck POS.
2. Description of Service
Food Truck POS is a point of sale application designed for food truck operators and mobile vendors. The App provides tools for:
- Managing menus, items, and pricing
- Taking and tracking customer orders
- Processing payments via Stripe
- Sending SMS order notifications via Twilio
- Syncing analytics to an optional web dashboard
- Coordinating orders between cashier and kitchen displays
3. Eligibility and Account
You must be at least 18 years old to use the App. By using it, you represent that you are of legal age and have the authority to enter into these Terms on behalf of your business.
You are responsible for maintaining the confidentiality of your login credentials and API keys. Notify us immediately at foodtruckposapp@outlook.com if you believe your account has been compromised.
4. Subscription and Billing
Free Trial
All new accounts receive a 14 day free trial with full access to all features. No payment information is required to start your trial.
Paid Subscriptions
After your trial, continued access requires a paid subscription. Plans are available at three tiers:
- Starter: $29 CAD per month, supports 1 iPad
- Professional: $59 CAD per month, supports up to 3 iPads
- Enterprise: $99 CAD per month, supports unlimited iPads
Subscriptions are managed through your web dashboard at foodtruckpos-dashboard.vercel.app and are billed monthly through Stripe. You can upgrade, downgrade, or cancel at any time through the billing portal in your dashboard.
Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial months.
Refunds
Refund requests are handled on a case by case basis. Contact foodtruckposapp@outlook.com within 7 days of a charge if you believe you were billed in error.
5. Payment Processing
Card payments taken through the App are processed by Stripe, Inc. By using payment features, you agree to Stripe's Terms of Service and Privacy Policy.
- We never store, transmit, or have access to full card numbers
- Transaction fees are set by Stripe and your merchant account agreement
- You are responsible for ensuring your use of payment features complies with applicable laws and card network rules
- Chargebacks, disputes, and refunds to your customers are governed by your Stripe merchant agreement
6. SMS Notifications
The App can send SMS messages to your customers via Twilio when orders are ready. By enabling SMS notifications:
- You represent that you have obtained appropriate consent from your customers to receive SMS messages
- You agree to Twilio's Terms of Service
- SMS costs are billed by Twilio to your Twilio account; we do not charge additionally for SMS
- You are responsible for complying with applicable SMS regulations including TCPA (US), CASL (Canada), and other applicable laws
7. Acceptable Use
You agree to use the App only for lawful business purposes. You must not:
- Use the App to facilitate illegal transactions or activities
- Attempt to reverse engineer, decompile, or extract the source code of the App
- Use the App in any way that could damage, disable, or impair our services
- Share your account credentials with unauthorized parties
- Use the App to send unsolicited communications to customers who have not consented
- Misrepresent your identity or business information within the App
8. Your Data and Content
You retain ownership of all business data you enter into the App, including menu items, customer records, and order history. This data is stored locally on your device and is not claimed by us.
By optionally syncing analytics to our backend dashboard, you grant us a limited, non-exclusive license to process and display that aggregated data solely for the purpose of providing the dashboard service to you.
You are responsible for the accuracy of data you enter and for maintaining your own backups. We are not liable for data loss resulting from device failure, accidental deletion, or app removal.
9. Intellectual Property
The App, including its design, code, graphics, and feature set, is owned by Food Truck POS and protected by copyright and other intellectual property laws. These Terms do not transfer any ownership rights to you.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your Apple devices solely for your business operations in accordance with these Terms and Apple's App Store terms.
10. Disclaimer of Warranties
We specifically disclaim any warranty that the App will meet your specific business requirements or that it will be suitable for use in regulated industries without additional compliance measures on your part.
11. Limitation of Liability
Our total aggregate liability to you for any claims arising from these Terms or the App shall not exceed the amount you paid for the App subscription in the 12 months preceding the claim, or $50 USD, whichever is greater.
12. Changes, Termination, and Contact
Changes to These Terms
We may update these Terms from time to time. We will update the "Last updated" date at the top of this page. Continued use of the App after changes constitutes acceptance of the updated Terms. For material changes, we will make reasonable efforts to notify you within the App.
Termination
You may stop using the App at any time by deleting it from your device. We reserve the right to suspend or terminate access to any account that violates these Terms. Upon termination, your license to use the App ceases immediately.
Governing Law
These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario.
